Argentina-Japan bilateral Investment treaty

Negotiations on the text of the Agreement between the Argentine Republic and Japan on Investment Promotion and Protection concluded this week.

The new instrument was negotiated by Argentina in the context of the Argentine Government's policy of promotion of foreign investment as the motor of growth and development in our country.

The treaty sets forth provisions guaranteeing adequate protection for Japanese and Argentine investments and investors, and lays the legal foundation for a balanced relationship between the States Parties and investors.

Its text incorporates the main recent recommendations on the negotiation of investment agreements made by international organizations such as the OECD and UNCTAD.

This new treaty sets a high legal certainty threshold for both States and investors and is an essential legal tool that is expected to contribute to the improvement of the business environment for the establishment of Japanese investments in Argentina, through the promotion and enhancement of the flow of investments between both countries.

The Agreement is under final legal review and the parties are working on the Annex details. It will be signed by the authorities of both countries soon on a date yet to be set.
